He was born on March 19, 1952, to a Jewish family. He completed his education with his younger brother, Bob in John Bowne High School. Around 1967, he graduated from University at Buffalo in New York. During those days, Harvey and Bob produced rock concerts for the love of music they shared. Later the Weinstein duo had grown up with a sheer passion for films which fostered a desire to enter into the film industry. In the 1970s, they initiated a small-scale independent film distribution company called as Miramax with the help of the profits gained from their rock concert business. This company was named after their beloved parents, Miriam and Max Weinstein.

They started off with a musically oriented pitch and did concert films like Paul McCartney's Rock show which gained popularity. In 1980’s the company got rights for two more British films aimed for Amnesty International, an HR organization. More films were produced later and Martin Lewis, the famous producer also worked with them. In 1982, with close interactions with Martin, the Weinstein brothers managed to release a film called "The Secret Policeman's Other Ball". This movie was the company’s debut hit film and also increased credits for the HR organization in the United States. Ever since then, there was no looking back; Harvey slowly built his commercial success. He did arthouse films in the 1980s and released a documentary "The Thin Blue Line". It was a turning point where he got critical attention and a huge amount of publicity.

The company eventually became one of the most successful and well-known independent studios in the United States. He also reached at the Cannes Film Festival by then. Few of his films included "Sex, Lies, and Videotape", "Tie Me Up! Tie Me Down", etc. He continued to grow and expand Miramax by doing so many films. He gained success to its best, so much so that he also cracked the ownership deal by Disney. With his deal agreement, Harvey opened the door to various opportunities. In March 2005, Harvey announced that he would leave Miramax and form his own production company.
